Terms & Conditions

Upon signature, and payment of the deposit, the Primary Organizer agrees to be bound by the Terms and Conditions set forth herein. Furthermore, upon receipt of the Terms and Conditions,” the “Release of Liability, Waiver of Claims, Assumption of Risk, and Binding Arbitration Agreement” (“Agreement”) will be sent to the Primary Organizer, and each Guest. The “Agreement” must be signed by the Primary Organizer, and each Guest within 14 days of booking. Participation on the trip will require that each Guest signs.

 

Terms Defined:

 

Blue & Beyond Adventures (“Blue & Beyond”, “B&B”, “us”, or “we”) refers to Blue & Beyond Adventures, LLC, and its respective employees, officers, and representatives.

 

Excursion or Event refers to any activity arranged by Blue & Beyond Adventures.

 

Expedition Leader refers to the individual(s) guiding a Blue & Beyond Adventures Trip, responsible for leading the Trip and overseeing the day-to-day activities of the Trip.

 

Guest refers to any individual(s) booked in a Blue & Beyond Adventures Trip.

 

Local Guide refers to guide(s) who assist in specific country(ies)/locations included in the Trip.

 

Primary Organizer refers to the designated responsible party acting on behalf of the Trip Guest/s.

 

Trip refers to the specific Trip arranged and organized by Blue & Beyond Adventures in which the Guest is participating.

 

1.  Planning Your Adventure

Blue & Beyond Adventures provide the finest Wild.Life.Adventures and Excursions on the planet. With this in mind, we take a hands-on approach to planning group and pre-planned Trips. Our representatives take inventory of the Excursions and Events important to creating a Trip of a lifetime.

 

2.  Reserve Your Adventure

Most of our trips require a 50% deposit to reserve your space, unless otherwise agreed. The exact deposit amount for each trip, along with the cancellation policy for that Trip will be provided in your booking documentation. Your deposit can be made by Visa, MasterCard, Discover, American Express or eCheck. Some deposits are nonrefundable. All prices are in U.S. dollars.

When you book one of our adventures, you agree to sign our Agreement which states that you and your party have read and understood the important information in this document, including a release of liability, and agree not to sue Blue & Beyond Adventures or its participating agents or representatives. On payment of a deposit, you agree to be bound by our Terms & Conditions. We require that these forms, including your completed Booking Form, are submitted within 14 days of making your initial booking and deposit. Failure to do so may result in the cancellation of your booking with no refund beyond that which is listed in our cancellation policy.

 

3.  Receive Confirmation
Upon receipt of your deposit, we will forward you the Trip forms in order to receive the details needed to plan the unique content of your adventure.

 

4.  Trip Forms
In order to reduce paper waste, Blue & Beyond Adventures provides all forms online. Our Agreementand all other forms will be sent by email and can be signed and submitted online. These forms must be submitted online within 14 days of booking, unless otherwise requested by Blue & Beyond Adventures.

 

5.  Final Payment
Final payment for most trips is due 120 days prior to departure, unless otherwise requested by Blue & Beyond Adventures. Some trips require the final balance to be paid earlier to secure arrangements. Please consult your booking documentation for details. For our Guests’ convenience, the final balance will be charged to their credit card on the final balance-due date, unless the guest indicates in writing prior to the final balance-due date a preference to pay by alternate means. If payment is not received by the final balance-due date, the guest(s’) reservation is subject to cancellation.

 

6.  Receive your Pre-Departure Briefing & Preparation Materials
Preparing Blue & Beyond Adventures Guests for their adventures is a priority for us.  Prior to departure, you will electronically receive a comprehensive email with details about your trip, what to pack, and how best to prepare.

Trip Cancellation & Refund Policy

Blue & Beyond Adventures understands how disappointing it can be in the event you are forced to cancel or change your long-anticipated adventure.  We must strictly adhere to our cancellation and trip change policy for all guests. We strongly suggest purchasing travel insurance in the event a guest must cancel or otherwise change their plans.

All cancellations and trip change requests must be made in writing by email and received and acknowledged by Blue & Beyond Adventures.


The following are the terms of Blue & Beyond’s cancellation and trip change policy:

All cancellations processed 121 or more calendar days prior to departure will incur a $100 cancellation fee per person. Based on the policies of outside vendors such as hotels; some trips include non-refundable deposits. Please consult your specific adventure itinerary for detailed information.

   

Cancellations made 61 to 120 calendar days prior to departure are assessed a cancellation fee of 50% of the entire trip price, including internal air, extensions, and extra services such as hotel nights.

   

Cancellations made 60 calendar days or less prior to departure are assessed a cancellation fee of 100% of the trip price, including internal air, extensions, and extra services such as hotel nights.

   

Custom-designed trips and extensions require a 25% nonrefundable deposit and follow our standard cancellation and trip change policy unless otherwise stated.

 

In the event either Blue & Beyond Adventures or the guest changes, reschedule or rebook a trip or extension, including custom-designed trips and custom-designed extensions, for any reason, including, but not limited to, force majeure, the cancellation and trip change policy as of the date of the original booking shall remain in full force and effect. For example, for any cancellation or trip change received between 61 to 120 calendar days prior to the departure of the originally booked date, a fee of 50% of the entire trip price, including extensions, will apply for the revised date regardless of the lead time of a cancellation of the revised departure date. Similarly, cancellations or trip changes received less than 60 calendar days prior to the original departure date shall be assessed a fee of 100% of the trip price, including any extensions, regardless of the lead time of a cancellation of the revised departure date.


 

Documents & Vaccinations

In order to join a Blue & Beyond Adventures trip, you are responsible for obtaining and maintaining all required documents and vaccinations. These can include, but are not limited to, valid passports, visas and vaccinations. For current passport and visa requirements, please visit travel.state.gov as well as individual country websites and/or embassies in the countries visited. For up-to-date vaccine information, please visit cdc.gov/travel. For individual country entry requirements, please visit the individual country websites and/or embassies. 

 

Guests are responsible for obtaining and maintaining all required documents and vaccinations in order to participate in a Blue & Beyond Adventures Trip. These can include, but are not limited to, valid passports, visas and vaccinations. Additionally, guests are responsible for knowing and meeting the entry and transit requirements of all countries they will be visiting or traveling through in relation to their Trip. Certain countries do not allow entry (even for a layover or transit) to travelers who have a criminal record or who have been charged with certain crimes (e.g., driving under the influence). 

Should a Guest not have the necessary, valid documents or vaccines, or not meet the entry or transit requirements and therefore miss some or all of a trip, Guest will not receive a refund of any portion of the Trip price, used or unused, nor will Blue & Beyond Adventures be responsible for any additional expenses incurred by the Guest as a result.


Getting to the Starting Point of Your Blue & Beyond Adventures Trip

Blue & Beyond Adventures’ Guests are responsible for arriving on time for the agreed upon departure and tour schedules. Should guests be delayed for any reason in getting to or departing from a trip, or must leave a trip early, Blue & Beyond Adventures is not liable for any additional costs incurred in joining or leaving the trip (such as costs for accommodations or transportation), nor will Guests receive a refund for any missed portion of the trip as a result of a late arrival or early departure.

Luggage Restrictions

Some of our trips have enforced restrictions on luggage weight, size or type (such as hard-sided luggage). Many vehicles have limited space, and when traveling in light aircraft, overweight conditions can create a serious safety hazard, thus we adhere to strict limits on luggage weight, size and type. All restrictions on carry-on baggage include camera equipment. Guests should pack light and follow the guidelines in our pre-trip materials. Baggage exceeding specified weight, size or type limits is subject to being left behind or forwarded at your expense.

Small Aircraft on Blue & Beyond Adventures Trips

On many Blue & Beyond Adventures trips, we use small aircraft to access our planet’s most remote and pristine wild areas.

 

Family Travel & Age Requirements

Blue & Beyond Adventures welcomes families on certain trips and offers select scheduled family departures. Children are encouraged to participate in Blue & Beyond Adventures trips. All itineraries are flexible and can accommodate children of all ages.

 

Trip Inclusions

Each itinerary includes a variety of features and elements unique to that specific adventure.

Gratuities

Blue & Beyond Adventures has made a concerted effort to pre-arrange tipping for local services, so you do not have to carry excessive cash and experience the inconvenience of ‘reaching into your pocket’ at every turn.

 

Guest Conduct and Limitations

Blue & Beyond Adventures operates Trips in natural areas where unpredictable conditions may exist. To avoid potentially dangerous situations, both for Guests and for wildlife, it is extremely important that all Guests obey the rules and regulations set forth by the Expedition Leader(s) and/or Local Guide(s) or other representatives of Blue & Beyond Adventures, and demonstrate reasonable consideration and respect for all staff, fellow Guests and wildlife. Additionally, Blue & Beyond Adventures reserves the right, in our sole discretion, to prohibit any Guest from joining or continuing on a Trip if, in our opinion, that Guest’s physical, emotional, or behavioral limitations or actions pose or could pose a threat to his/her safety or enjoyment, or that of other Guests or staff, or the safety of wildlife.

 

Disrespectful, inappropriate or lewd behavior, foul language, excessive intoxication, or other behaviors that could endanger or negatively impact others will not be tolerated, and Guests may not be permitted to join or continue on a Trip in such circumstances. Should a Guest not be permitted to join a Trip or be asked to leave a Trip in progress, there will be no refund of any portion of the Trip price, used or unused, beyond that which is listed in our cancellation policy, nor will Blue & Beyond Adventures be responsible for any additional expenses incurred by the Guest as a result of his/her dismissal.

 

Viewing Wildlife

Since most Blue & Beyond Adventures trips specialize in viewing wildlife, every effort is made to arrange itineraries to places where wildlife is known to exist. However, the animals we encounter live wild and free, and we cannot fully predict nor control their movements (nor would we want to). In an attempt to locate wildlife that may have deviated from its normal movement patterns, or in the interest of traveler comfort, safety or other circumstances, we may be required to make changes to accommodations, modes of transportation, activities or other itinerary elements, sometimes with little or no notice.

Wildlife viewing may vary significantly due to numerous factors including wildlife movements and behavior, weather conditions, human interference, climate change, and changes in species biodiversity and density in the various locations visited. While Blue & Beyond Adventures makes best efforts to provide an outstanding wildlife viewing experience, we cannot guarantee that availability, diversity and/or quantity of wildlife, including items described on our website.

 

Blue & Beyond Adventures adheres to all rules, regulations and cultural norms as they relate to local, state and federal wildlife statutes. Our itineraries and tour guidelines are specifically created with these regulations in mind. Blue & Beyond Adventures reserves the right to pause or terminate a tour in the event guest(s) refuse to adhere to the itinerary, guidelines or instructions given by Blue & Beyond Adventures staff, and/or contracted tour guidelines, including safety of self, others and the safety and protection of animals and habitat. Blue & Beyond Adventures will not be responsible to refund any portion monies received in the event of a termination of a tour or excursion.

Providing Truthful, Current and Complete Information 

When completing the Travel Information Form Guests are asked to provide information about fitness to participate in activities, including medical conditions, dietary restrictions or allergies, it is very important that answers to each question are truthful, current and complete in order for us to ensure the quality of our Trips for all Guests. One or more Guests who cannot perform the required physical activities, however limited those activities may be, may adversely affect the experience for the entire group. If it is determined that Guest has provided false information or concealed any information regarding existing condition(s), or a new condition which has arisen, and is subsequently unable to participate fully in a Trip as a result, Blue & Beyond Adventures reserves the right to cancel Guest’s participation in the Trip without any refund beyond that which is listed in our cancellation policy. If a Trip is in progress, and Guest requires additional services or is required to be evacuated from a Trip as a result of such failure, Guest will be charged all extra expenses, including evacuation expenses, and will not receive a refund for any unused Trip services.

 

Physical Requirements

Our trips are intended for individuals in good physical and mental health, with reasonably good mobility. In order to provide a fulfilling trip experience for all travelers, we will work with you to participate in the required physical activities for your chosen trip based on your honest disclosure of physical capabilities made to us and will make accessibility arrangements on your behalf when possible. Blue & Beyond Adventures is committed to availing our adventures to clients of all ages. Certain trips may require that you obtain medical approval before departure. Additionally, Blue & Beyond Adventures reserves the right, in our sole discretion, to prohibit you from joining or continuing on a trip if, in our opinion, your physical, emotional or behavioral limitations or actions pose or could pose a threat to your safety or enjoyment, or that of other guests or staff, or the safety of wildlife.

 

Dietary Restrictions and Allergies

Blue & Beyond Adventures can generally accommodate common dietary restrictions on all of our trips, such as vegetarian, dairy-free, gluten-free, though limitations on food variety may exist. However, given the nature of our trips, Blue & Beyond Adventures cannot guarantee that allergens or items on your restriction list will not be present at our camps/lodges or elsewhere during a Trip. Ultimately, you must take responsibility for your own health and safety and understand that we cannot guarantee against contamination or airborne transmission.

Cell Phones & Other Electronics

Our adventures are designed to provide our guests with immersive nature experiences. With this goal in mind, we try our very best to minimize the use of electronic devices on our trips. We respectfully ask that guests not use mobile phones or tablets/computers in the presence of other guests, unless such use is an integral component of the trip, as when a phone is used as a camera, or on special photography departures where Guests may come together to edit photos on computers in the evenings. This policy is especially applicable in secluded or enclosed areas, during presentations, ceremonies, or at mealtimes when we are often recapping our day, preparing for the next day, or sharing stories of our nature encounters. Drone usage: Only Blue & Beyond company drones can be used where they have obtained permission and license for acceptable use.

Smoking on Blue & Beyond Adventures’ Trips

Travelers may not use cigarettes, cigars, e-cigarettes, vaporizers, marijuana or any other such item in areas where others are affected, such as in vehicles, within enclosed areas, or in the presence of others. Most accommodations we secure do not allow smoking, and additionally, trips generally have limited opportunities where smoking is permissible. Blue & Beyond Adventures will not alter or change activities or adversely affect other guests to accommodate those who smoke.

Alcohol, Prescription Medications & Illegal Drugs

Guests of legal drinking age in the U.S. may enjoy alcohol in moderation on trips. Excessive intoxication or other behaviors resulting from alcohol or other substance use, including prescription or over- the-counter medications, which pose or could pose a threat to a Guest’s safety or enjoyment, or that of other Guests or staff, or the safety of wildlife, will not be tolerated, and the Guest may not be permitted to continue on a Trip in such circumstances. The use of illegal drugs (defined as illegal in the country or region visited) is never permitted on any Blue & Beyond Trip and is grounds for immediate dismissal from a Trip. Guests are responsible for knowing and observing the licensing and other laws for drug possession, including both prescription medications and illegal drugs for all countries and states visited. The use of recreational marijuana, even where legal, is also never permitted on any Blue & Beyond Adventures Trip and is grounds for immediate dismissal from a Trip. Should a Guest be asked to leave a Trip in progress, there will be no refund of any portion of the Trip price, used or unused, nor will Blue & Beyond Adventures be responsible for any additional expenses incurred by the Guest as a result of his/her dismissal.

 

Harassment Policy

Blue & Beyond Adventures is committed to providing Trips free from any form of harassment and disrespectful or other inappropriate conduct based on sex (including pregnancy, childbirth, breastfeeding or related medical conditions), race, religion (including religious dress and grooming practices), color, gender (including gender identity and gender expression), national origin, ancestry, physical or mental disability, medical condition, marital status, registered domestic partner status, age, sexual orientation, military and veteran status or any other basis protected by federal, state or local law or ordinance or regulation. Prohibited harassment, disrespectful or inappropriate conduct includes, but is not limited to, the following behavior: 1) verbal conduct such as epithets, derogatory jokes or comments, slurs or unwanted sexual advances, invitations, comments, posts or messages; 2) visual displays such as derogatory and/or sexually oriented posters, photography, cartoons, drawings or gestures; 3) physical conduct including assault, unwanted touching, intentionally blocking normal movement or interfering with the Trip because of sex, race or any other protected basis; and 4) threats and demands to submit to sexual requests or sexual advances. Guests should report any harassment, disrespectful or inappropriate conduct immediately to the Expedition Leader(s). Harassment, disrespectful or inappropriate conduct may be grounds for immediate dismissal from a Trip. Should a Guest be asked to leave a Trip in progress, there will be no refund of any portion of the Trip price, used or unused, nor will Blue & Beyond Adventures be responsible for any additional expenses incurred by the Guest as a result of his/her dismissal.

Firearm Policy   Guests are prohibited from bringing, carrying or utilizing any type of firearm on all Blue & Beyond Adventures Trips. On certain Trips, Expedition Leader(s) and/or Local Guide(s) may carry firearms for safety purposes only. 

Personal Property

Blue & Beyond Adventures is not liable for any lost, stolen or damaged personal property, including but not limited to cell phones, camera equipment, computers, tablets, luggage or personal belongings, money, credit or debit cards, personal identification documents such as passports, licenses or other travel documents, etc. We strongly recommend the purchase of travel insurance to help protect against potential loss or damage.

 

Itinerary Changes or Cancellation

Adventure travel is inherently prone to complications and alterations. In some circumstances, it may be necessary to change accommodations, transportation, activities or other services, sometimes with little or no notice. In such cases, Blue & Beyond will make reasonable efforts to provide comparable substitutions wherever possible. Blue & Beyond will keep guests updated on any changes that may affect guests’ arrival or departure.

In the event of a force majeure, which shall include, but not be limited to, an act of God, natural disaster, epidemic, pandemic, government issued travel restriction or advisory impacting any portion of the trip or extension, or any other reason beyond the control of Blue & Beyond Adventures, we may at any time, before or after a trip or extension departure, and without notice, cancel the trip or extension, change the date of trip or extension, increase the fare as circumstances warrant, rebook guests on a similar trip or extension, or reschedule the departure date. In the event of cancellation due to force majeure or otherwise, we shall, in its sole discretion, have the right, upon written notice to guests and without further liability.


Marketing Materials

The images shown in our printed materials and on our website represent what our guests have regularly seen on “typical” trips in the past (or in the case of a new or Exploratory trip, what our staff and researchers have previously seen). Due to the weather and/or shifting wildlife conditions, some trips may have fewer close encounters with wildlife than we normally anticipate. Also, be aware that some images in our materials are taken with a telephoto lens, and guests should not assume that they will get very close to wildlife in such circumstances. For example, we may show a close-up shot of a whale, viewed through a telephoto lens, but nearly all of our encounters with whales are at a distance.

Privacy Statement

When a Guest books a Blue & Beyond Adventures Trip, Blue & Beyond Adventures will collect certain personal identifying information including but not limited to addresses, telephone numbers, email addresses, credit card information, passport information, emergency contact information and personal/medical information. All Guest information collected by Blue & Beyond Adventures is governed by our Privacy Policy. Please see the Privacy Policy page on our website for details. All health information is treated as confidential.
